Terms of Service
Last updated: October 23, 2026
Plain-English summary
This summary is provided for convenience — the binding terms are in the numbered sections below.
- WorkNoteNow provides a medical evaluation. Paying for the evaluation does not guarantee a doctor's note, any particular diagnosis, or employer acceptance of documentation.
- All clinical decisions are made by the evaluating clinician, not by WorkNoteNow.
- You are responsible for the accuracy of the information you submit and for following your employer's policies and applicable law.
- Disputes are resolved through binding individual arbitration, not class actions — see the arbitration and class-waiver sections.
- Refund eligibility is limited; see the Refunds and Cancellations section and our Refund & Cancellation Policy.
1. Acceptance of these terms
These Terms of Service form a legally binding agreement between you and WorkNoteNow (“we,” “our,” or “us”) regarding your use of this website and any services offered through it. By accessing, browsing, creating an account, scheduling an evaluation, submitting a form, or purchasing a service, you represent and warrant that:
- You are at least eighteen (18) years old, or are using the services with the direct involvement and authorization of a parent or legal guardian where permitted by law.
- You have the legal capacity and authority to enter into a binding agreement.
- All information you provide is truthful, accurate, current, and complete.
- Your use of the services does not violate any applicable law or the rights of any third party.
2. Definitions
- “Services” means the website, telehealth evaluations, scheduling, documentation delivery, communications, and related offerings provided through WorkNoteNow.
- “Clinician” or “Provider” means an independent, licensed healthcare professional who performs evaluations.
- “Documentation” means any work-absence note, work restriction, or similar document a Clinician may issue following an evaluation.
- “User,” “you,” or “your” means the person accessing or purchasing the Services.
- “Content” means text, images, graphics, audio, video, data, and other materials available through the Services.
3. Nature of the service — evaluation only
WorkNoteNow provides administrative and technology services that connect you with a licensed Clinician for a telehealth evaluation related to work-absence documentation. We are not a medical practice, not your employer, and not a law firm. We do not practice medicine, provide legal advice, or issue documents ourselves. Your purchase is payment for the evaluation (and associated administrative work), not payment for a particular clinical outcome or a guaranteed document.
4. No guarantee of a note or employer acceptance
We do not guarantee, and you should not assume, that:
- You will receive a doctor's note or any other Documentation;
- A Clinician will issue any particular Documentation, diagnosis, or work restriction;
- Any employer, school, insurer, court, or other authority will accept or honor the Documentation;
- The Documentation will excuse any particular absence or satisfy any particular workplace policy.
5. Medical providers and clinical decisions
Evaluations are performed by independent licensed Clinicians. Clinicians exercise their own independent medical judgment and may decline to issue Documentation, may issue Documentation with limitations, may require additional information, or may refer you to in-person or emergency care. WorkNoteNow does not direct, influence, override, or second-guess any Clinician's clinical decision. If a Clinician determines that Documentation is not medically appropriate, you will receive a refund as described in our Refund & Cancellation Policy.
6. Not medical advice; no emergency services
Content on this website is provided for general informational purposes only and is not medical advice, diagnosis, or treatment. Always consult a qualified clinician with questions about your health. The Services are not appropriate for emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.
7. Eligibility requirements
To use the Services, you must (a) be at least 18 years old or use the Services under the authority of a parent or legal guardian, (b) be physically located in a state in which we offer the Services at the time of your evaluation, (c) be legally capable of entering into a binding contract, and (d) not be barred from receiving the Services under applicable law. We reserve the right to decline, restrict, or suspend Service availability to any user for any lawful reason.
8. State-specific availability
The Services are offered only in U.S. states where we and our Clinicians are authorized to operate. Availability, scope, and pricing vary by state and are shown on the booking page. Nothing on the website constitutes an offer to provide Services in a state where such offer would be unlawful.
9. User responsibilities & accuracy of information
You agree to:
- Provide truthful, current, and complete information at all stages, including registration, intake, scheduling, payment, and follow-up;
- Submit only documents and records you are legally authorized to provide;
- Attend scheduled evaluations on time and in an environment suitable for a medical visit;
- Be physically located in the state you selected during your evaluation;
- Follow all lawful instructions from WorkNoteNow and the Clinician regarding scheduling, documentation, payment, and communication;
- Update your information if it changes, and promptly correct any inaccuracies;
- Use the Services only for lawful purposes and in accordance with these Terms.
10. Prohibited uses
Submitting false, forged, altered, or materially incomplete information may result in refusal of service, revocation of Documentation, forfeiture of fees, and referral to appropriate authorities. You may not (and may not authorize or assist any third party to):
- Use the Services to defraud, mislead, harass, or harm any person, including any employer;
- Impersonate another person or misrepresent your affiliation with any person or entity;
- Submit false or altered medical records, identification, or supporting documents;
- Attempt to circumvent, disable, or interfere with security features of the website;
- Reverse-engineer, scrape, crawl, or harvest data from the Services except as expressly permitted;
- Upload malware, viruses, or any other harmful code;
- Use the Services to violate any applicable federal, state, local, or international law;
- Resell, sublicense, or commercially exploit the Services without our prior written consent.
11. Screening and documentation requirements
You may be asked to complete intake forms, provide identification, or submit supporting information before, during, or after an evaluation. You are responsible for making sure submitted materials are legible, accurate, and belong to you. If required materials are missing, illegible, or unverifiable, your evaluation may be delayed, rescheduled, or canceled.
12. Communications consent (calls, SMS, email)
By providing your phone number or email address, you consent to receive transactional, appointment-related, and service-related communications from WorkNoteNow and our service partners, including by telephone, SMS/MMS, and email. Message and data rates may apply. Marketing communications require separate, optional consent. You may opt out of promotional messages at any time; transactional and safety messages may continue where permitted by law. SMS opt-out instructions are included in each marketing message (reply STOP to unsubscribe; HELP for help).
13. Consultation platform and recording consent
Evaluations may be conducted by phone, video, or asynchronous messaging via our telehealth vendors. By participating, you agree that your evaluation may be recorded or transcribed for medical, quality-assurance, compliance, or dispute-resolution purposes, to the extent permitted by law. Recordings are treated as protected health information and retained according to our retention schedule. If you do not consent to recording, notify us in writing before your evaluation.
14. Fees, payments, and billing
All fees are disclosed at the time of purchase and are payable in U.S. dollars. By providing payment information, you authorize WorkNoteNow and our payment processors to charge the specified amount plus any applicable taxes. Fees may change from time to time; the fees in effect at the time of your purchase govern that purchase. You are responsible for keeping your payment information current. If a payment fails, we may suspend or cancel your evaluation until payment is received. Chargebacks initiated without first contacting us may be disputed and, if found invalid, may result in account termination and collection activity.
15. Refunds and cancellations
Refund eligibility and timing are governed by our Refund & Cancellation Policy, which is incorporated by reference. In general, a non-refundable administrative fee of $35 applies to eligible refunds to cover payment-processor, platform, and administrative costs. If your evaluating Clinician determines that a work-absence note is not medically appropriate, you will receive a refund as described in the Refund & Cancellation Policy. Cancellation windows and reschedule policies are posted at checkout and in your confirmation email.
16. Delivery of documentation
When a Clinician issues Documentation, it is delivered electronically through your secure account. You are responsible for maintaining access to your account and for downloading and safeguarding your documents. We do not guarantee that any employer or third party will accept electronically delivered Documentation.
17. Employer policies and legal compliance
Workplace absence policies, attendance rules, and documentation requirements vary by employer and jurisdiction and change frequently. WorkNoteNow provides general information and Documentation facilitation; we do not provide legal advice. You are solely responsible for understanding and complying with the policies and laws applicable to you, including your employer's call-in procedures, absence-notification deadlines, and any applicable leave laws.
18. Your health and return-to-work decisions
Even if you receive Documentation, you are solely responsible for your own health decisions, including when to return to work. Follow the Clinician's guidance and seek further care if your condition worsens. WorkNoteNow disclaims any responsibility for outcomes resulting from your decision to work or not work, or from your failure to seek appropriate follow-up care.
19. Health information and privacy
Information collected during evaluations may constitute protected health information under applicable federal and state privacy laws, and is handled in accordance with applicable law and our Privacy Policy. Our Privacy Policy describes what information we collect, how we use and disclose it, and the choices available to you. By using the Services, you acknowledge that you have reviewed our Privacy Policy.
20. Third-party services and payment processors
We rely on third-party vendors for payment processing, scheduling, video conferencing, SMS, email, analytics, and similar operational needs. Your interactions with these vendors are governed by their own terms and privacy policies. We are not responsible for the acts, omissions, outages, security incidents, or policies of third parties except to the extent required by law or by our written agreements with them. Links to third-party websites are provided for convenience only and do not constitute an endorsement.
21. Intellectual property rights
All Content on the website — including text, graphics, logos, trademarks, photographs, audio, video, software, and compilations — is the property of WorkNoteNow or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. Except for your personal, non-commercial use as expressly permitted, you may not reproduce, modify, distribute, republish, scrape, frame, transmit, or otherwise exploit any Content without our prior written permission. The WorkNoteNow name and logo are our trademarks; all rights reserved.
22. User-submitted content and license
You retain ownership of information and materials you submit (“User Content”), but by submitting User Content, you grant WorkNoteNow a worldwide, royalty-free, non-exclusive license to use, reproduce, store, transmit, and display that User Content to the extent necessary to provide the Services, comply with law, and resolve disputes. You represent and warrant that you have all rights necessary to grant this license and that the User Content does not violate any law or third-party right.
23. Privacy Policy
Our Privacy Policy is incorporated into these Terms by reference and describes how we collect, use, share, and protect information about you. By using the Services, you acknowledge and agree to our Privacy Policy.
24. Cookies and tracking technologies
We and our service providers use cookies, pixels, local storage, and similar technologies to operate the website, remember your preferences, measure performance, and support marketing. You can manage cookie preferences through your browser settings or any cookie banner we display. Disabling certain cookies may impair website functionality.
25. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, OR ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. Without limiting the foregoing, we do not warrant that:
- The Services will be uninterrupted, timely, secure, or error-free;
- Evaluations will result in Documentation, or that any Documentation will be accepted by any employer or authority;
- Information on the website will always be accurate, complete, current, or suitable for your situation;
- Defects will be corrected, or that the Services are free of viruses or other harmful components.
26. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WORKNOTENOW AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, PROVIDERS, AND SERVICE PROVIDERS (COLLECTIVELY, THE “RELEASED PARTIES”) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE RELEASED PARTIES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO WORKNOTENOW FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
27. Indemnification
You agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your misuse of the Services; (b) your violation of these Terms or any applicable law; (c) your violation of any third-party right, including privacy, publicity, or intellectual-property rights; (d) any information or documents you submit; (e) your use of any Documentation obtained through the Services, including with any employer; and (f) any interaction between you and a Clinician. We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification.
28. Account suspension and termination
We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms, submitted inaccurate information, engaged in abusive conduct, or created risk to WorkNoteNow or its users. Upon termination, all rights granted to you under these Terms cease immediately, but sections that by their nature should survive termination will survive.
29. Force majeure
We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, civil unrest, labor disputes, utility outages, internet or telecommunications failures, governmental actions, or failures of third-party vendors.
30. Assignment
You may not assign or transfer these Terms or any rights or obligations under them, by operation of law or otherwise, without our prior written consent. We may assign these Terms, in whole or in part, without notice to you, including in connection with a merger, acquisition, reorganization, financing, or sale of assets. Any attempted assignment in violation of this section is void.
31. Governing law and jurisdiction
These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules, and the laws of the United States applicable therein. Subject to the arbitration provisions below, the state and federal courts located in Wayne County, Michigan will have exclusive jurisdiction and venue for any action not subject to arbitration, and you consent to personal jurisdiction in those courts.
32. Dispute resolution — informal resolution first
Before filing any claim against WorkNoteNow, you agree to first attempt to resolve the dispute informally by contacting us at tory@myeyerx.net with a written description of the claim, your contact information, and the specific relief sought. We will attempt in good faith to resolve the dispute within sixty (60) days. Only if the dispute is not resolved within that period may either party initiate a formal proceeding subject to the arbitration section below.
33. Binding arbitration agreement
Please read this section carefully. It affects your legal rights. Except for disputes qualifying for small-claims court and except for actions seeking injunctive relief for intellectual-property infringement, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, not in court. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by these Terms. The arbitration will be conducted in the English language and seated in Wayne County, Michigan, unless otherwise agreed. The arbitrator — and not any federal, state, or local court or agency — will have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement. Judgment on the award may be entered in any court of competent jurisdiction.
34. Class action and jury trial waiver
YOU AND WORKNOTENOW AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. You and WorkNoteNow also each waive any right to a trial by jury. 30-Day Opt-Out Right: you may opt out of this arbitration agreement and class-action waiver by sending written notice to WorkNoteNow at the contact address in the Notices section within thirty (30) days of first accepting these Terms. Your notice must include your full legal name, address, email, and a clear statement that you wish to opt out of arbitration.
35. Electronic signatures and records (E-SIGN)
You consent to transact with us electronically and agree that electronic signatures, contracts, and other records have the same legal effect, validity, and enforceability as manually signed paper documents, consistent with the federal E-SIGN Act and applicable state Uniform Electronic Transactions Acts. You can withdraw this consent at any time by writing to us at the contact address in the Notices section, but doing so may prevent you from using the Services.
36. Accessibility (ADA/WCAG)
WorkNoteNow is committed to digital accessibility and strives to conform to Level AA of the Web Content Accessibility Guidelines (WCAG) 2.1. If you encounter any barrier to using our website, please contact us at tory@myeyerx.net with a description of the issue and we will work to assist you.
37. State consumer privacy rights
Residents of certain states, including California, may have additional privacy rights under state law, such as the right to know, access, correct, delete, or opt out of certain uses of personal information. Our Privacy Policy describes these rights and how to exercise them.
38. Severability
If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
39. No waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later. Any waiver must be in writing and signed by us.
40. Entire agreement
These Terms, together with the Privacy Policy, Refund & Cancellation Policy, Telehealth Consent, and any other policies incorporated by reference, constitute the entire agreement between you and WorkNoteNow regarding the Services and supersede all prior or contemporaneous understandings.
41. Modifications to these terms
We may update these Terms from time to time. The “last updated” date at the top of this page shows when they were last revised. Material changes will be posted on this page, and continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
42. Notices
Legal notices to WorkNoteNow must be sent to 25525 Elba St, Redford, MI 48239 or tory@myeyerx.net. We may provide notices to you at the email address associated with your account.
43. Contact information for disputes
For questions about these Terms or to initiate informal dispute resolution, contact us at tory@myeyerx.net or (734) 290-3834.
